Examining an articulated phenomenology (originally sketched by Niklas Luhmann) of different forms of reaction to the violation of a norm (which includes sanction, but is not reducible to sanction), the author investigates the role of what he calls "nomotrophic behaviour" on the epistemological level of the inference of norms, and on the ontological level of the existence of norms, suggesting that the investigation of desuetude (a way in which norms can come to inexistence) and "dying law" can shed a light on the mode of existence of norms and live law
